Is it illegal to download videos of beta testing?

I know its breaking NDA for people to post videos of there experience in some closed beta versions of unreleased video games. My question is if its illegal to download those videos? Some people on here might say, sure it's illegal but whose gonna find out? (like illegal downloading music). But I'm not asking who would find out, I'm asking if it is illegal or not.
